A Healthcare directive, also known as an Advance Health Care Directive or Living Will, is a legal document in which an individual nominates an “Agent” to act on his or her behalf in making health care decisions, in the event the individual becomes incapacitated. A medical directive also allows an individual to make decisions about end of life care, organ donation, and even burial or cremation instructions.
Without a Medical Directive, family members must make health care decisions for an incapacitated individual without knowing their wishes. In the event family disagrees on medical decisions, they must petition the probate court for a conservator to be appointed.
